Regulatory Framework
The Law on the Market of Securities and Other Financial Instruments represents the basic legal framework for the founding, organization and operation of the Belgrade Stock Exchange, as well as for the founding and business operation of BSE members – participants on the organized market and other capital market institutions. This Law regulates:
1. Conditions and procedures of issuing of securities;
2. Securities trading on the organized securities market;
3. Organization, structure and manner of functioning of the organized market in the Republic of Serbia;
4. Definition and activity of the market operator;
5. Founding and operation of the participants on the organized market;
6. Organization and competences of the Securities Commission;
7. Organization and competences of the Central registry, Depository and Clearing of securities.
The provisions of the Law relating to securities are applied to other financial instruments, if not otherwise stipulated by the Law.
The Law on the Market of Securities and Other Financial Instruments closely regulates the following matters relevant to the Exchange organization and operation: legal status; basic capital; founders; activity; staff and organizational capacity and technical equipment; issuing of licence; entry into the competent registry; use of the name; management; employees; general rules; change of the name of the registered office and address; Exchange members; information systems; arbitrage; admission and beginning of securities trading; suspension of securities trading; supervision and cessation of work.
The Stock Exchange is also regulated by the provisions of the Law on Business Companies, if not otherwise stipulated by the Law on the Market of Securities and Other Financial Instruments.
